Description
A document handwritten on ruled paper, it is an Article of Agreement, a copy registered as Instrument No. 2729. It is dated October 7, 1850 between David Eby, Waterloo Township, Waterloo County, Province of Canada, yeoman, and David B. Eby, same place, Cooper. It is an agreement to purchase part of Lot 32 German Company Tract "except the reservation contained in the conjugal patent from the Crown containing 219 1/2 acres of land." The sum of £900 to be paid in yearly installments to 1853. "David B. Eby is to keep a horse on the said farm and two sheep for the said David Eby and the privilege to go in the orchard and take the apples of eight trees of his own choice, which he is to mark, and have during his natural life." The Agreement was recorded March 7, 1856 as Liber B6 Folio 439 No. 2729. It was also recorded as Exhibit A mentioned in the declaration of David B. Eby taken September 15, 1896.
